Sewickley man faces assault and public drunkenness charges.
The preliminary hearing for a 30-year-old man charged with assaulting police officers and kicking out the window of a police car in a Wexford Plaza incident was postponed Friday. The hearing for Eric David Baumgartner of Sewickley was moved back to 9 a.m. July 15 before Magisterial District Judge Regis Welsh Jr. This is the second postponement. He faces two felony counts of aggravated assault, two misdemeanor counts of simple assault, two misdemeanor counts of recklessly endangering another person, one misdemeanor count of criminal mischief and one summary count of public drunkenness, court records state. A Sewickley man is scheduled for a preliminary hearing Friday on charges of assault and public drunkenness after failing a field sobriety test, kicking out the back window of a police car and kicking two police officers as they got him out of the car, according to a Northern Regional Police Department Report. An Allegheny County judge dismissed charges against a Darlington Township supervisor who had been accused of pulling a gun on a Pine Township man, calling the case "a bunch of crap." Common Pleas Judge Donna Jo McDaniel on Wednesday found John Raymond Nicely, 59, and his co-defendant, 29-year-old Michael Stepek, not guilty of all charges. The judge wrapped up the non-jury proceeding after telling onlookers in her courtroom that the case should have been tried across the street -- not in civil court, but in family court because "you're all behaving like children," she said. New Castle woman alleges the Wexford doctor touched her inappropriately.
Police in a second county have filed charges against Dr. Thomas Tyma, the Wexford doctor who has been accused of sexually assaulting patients during office exams. Tyma now faces charges of indecent assault and harassment in Lawrence County in connection with an incident in early October at Jameson Hospital South Campus, according to an affidavit signed by Sgt. Kevin Seelbaugh of the New Castle police. Those charges were filed Feb. 14. Tyma, a rheumatologist with Allegheny North Arthritis Center of Wexford, performed a breast examination on a patient at Jameson, even though her medical complaint was an arthritic knee, the affidavit stated.
